Dear Sirs **I have been a loyal customer of EBay since **** with ***% positive feedback. I am not a seller I am a buyer and a collector.**My username is taxbod and if you would care to take a look at my account you will see I use eBay to buy some essentials and items I collect, stamps, watches, bags etc.**I have recently this past * weeks had a flurry of buying watches, some clothes as well as some hand bags for my wife. **I have to say in the past I have had no issues with EBay, however o discovered on a telephone call to your appeals tram over the weekend that for some reason my account was banned from selling during ****, which is something I was not aware of. **In any event, you will see that on * or * July my account was suspended indefinitely because i had reported two return cases where the goods received were not what was shown on the site or not as described. **The first was a YSL bag I won, paid for and when the parcel arrived I opened it up and it was a completely different bag. I immediately took pictures and opened a return case and posted them and claimed a refund. The seller disputed this and even denied including the shipping docket which was with the item. I told the seller I would return it for a refund. I was waiting to be able to ask eBay to step in and then I received an email to say eBay had refunded my money as a courtesy. I had assumed that the seller had simply posted me the wrong item and so my bag must be with the person that paid for the bag I was holding. So I wrote to the seller and said I'd return the bag. Then my account was closed down and I was unable to obtain the address of the person I recall was called Skelton. The price was £*** plus shipping. I did receive a message from eBay to say they had refunded me the money as a courtesy but nothing was received. So I am holding a bag I didn't order, and I have been told by eBay the seller won the dispute and I have lost *** pounds due to either the seller mis packing the items or sending me something of much less value. Either way the terms of eBay should provide a resolution.**There is a second return and refund case open which is that detailed below which is the most concerning. I won an item for £*** Gucci bag which was advertised as genuine with receipt and box with no dust bag. The seller said the receipt would be shipped with the item.**My daughter opened the box and said the bag was here so I left positive feedback. However when I returned him and checked the item myself it did not feel genuine and the quality of the bag was not high end as you would expect from Gucci. The stitching and logos are out of line and when compared to pictures on the Gucci website it looked quite different upon close inspection. As well as that, the receipt did not feel right and seemed to be a copy. Plus when I inspected the bag I received it also was not even the same one as was advertised.**I reported all of this on the return as you will see form my account and the seller (who I note now has only a history of * transactions) called me unprofessional and maintained its genuine and suggested I visit a Gucci store.**I was concerned to do that and was worried if Gucci would report me for holding counterfeit goods, so I went to the Gucci store in Elements Mall, Kowloon, Hong Kong and explained my situation to the senior sales person of the store, leaving the bag at home. He was actually very helpful and accommodating and spent around ** minutes with me allowing me to take numerous photographs of the original bag off the shelf for comparison.**He inspected the receipt and said that the item code on the receipt is incorrect. **He also identified the differences in the quality of the lining in the bags and that the real one is made of leather and the one I have appears to be plastic, which it is. **I am suggesting that the bag is a fake and the receipt is a fake copy and I am claiming a refund under eBay's money back guarantee if I cannot seek a refund from this seller who has ripped me off. **I really cannot understand how my account can be indefinitely suspended without even discussing the cases and seeing out the investigation. This is a serious amount of money which when added to the other *** I am out of pocket takes me to almost *** pounds. Again the terms if eBay should at least provide some resolution here. I read an article in the Daily Mail from March written by Victoria Bischoff that said there are teams of people in eBay trying to stop this from happening and here I have been treated as the villain ripping people off when It is I who has been compromised and when I called eBay they told me it is tough, they decision is final and the system isn't here to protect members from people like me!**Since this has happened my wife has identified an identical listing for the lsame bag slightly different and posted the screenshots of these on the case return and have been waiting to be able to ask eBay to step in but instead it closes me down without hearing.**I called ebay appeals department and a nice Filipino chap called Adam was very helpful and listened to me and said he would speak to the appeals department and after around an hour the result was that I'm a bad customer and I was closed down to protect th eBay members, that that decision is final and that I will now have to proceed through PayPal. **I tried to explain that all my purchases were from credit car and none of them show up on PayPal.**I received a whole pile of emails from eBay to say it has cancelled all my transactions and that goods may not be received and that my account is now closed. **As it stands there are new a few items waiting to be delivered and I dont known what will or won't be delivered or when or how to track it and most importantly have recourse for my *** pounds paid which I am supposed to be protected over by eBay and the *** pounds eBay saidbthqt would refund but have not.**I totally dispute my account being closed and emplore someone please to investigate my case. **My wife found an article in the daily mail form March **** which explains this type of activity which I have encountered and from where I got your email address. **I cannot believe that eBay would just do this without looking into it or speaking to me to find out my side of the story. **I have posted photographs on the return case I took of the Gucci bag I received and the box it came in, on my dining room table..**I also took photographs of the bag at the Gucci store which can be seen quite clearly from th backgrounds and the counter up in which the bag is placed. I can provide all these as proof.**I have a sequence of photographs of the genuine Gucci bag in the shop and of the counterfeit bag on my table. I have emailed *****@***.com which was detailed in the newspaper article but received no reply.**The difference is clear to see in the quality of the material, the stitching, the alignment of the logos, when they are put side by side it's plain to see and if you have experts in identifying fake items like the Daily Mail said and you will see this immediately. **I also enclosed a copy of the receipt. The store person said that the reference number is incorrect on the receipt and we did a search on their system and there is no such number. **I would like eBay to step in here and feel that I deserve that opportunity things considered and that my account should be reinstated.**I look forward to hearing from you.**Yours faithfully **Christian Brown****** **** ****
