October **, ********* Tuckerman Street NW*Washington DC *******Government of the District of Columbia*Office of the Chief Financial Officer*Office of Tax and Revenue***** *th Street SW*Washington DC *******RE: **** Tax Return – Notice of Penalty and*or Interest Due***TURBO TAX SOFTWARE:*I used Turbo Tax Home and Business (TTHB) software to prepare and file my **** Internal Revenue Service (IRS) and District of Columbia Tax Return (DCTR). This software package covers the sale of a homes. I answered all the question in the software package related to the sale of my home. I filed my **** IRS and DC tax returns on time before April **, **** using the e-file service included in the TTHB software package and my tax return was accepted by the IRS and District of Columbia Office of Tax and Revenue (DCOTR) on February *, ****. This tax Return showed a tax refund of $**,*** from the IRS and $***.** from DC.**I received Tax Notice CP***** AUR Control Number *****-**** in late August of **** from the IRS.. I then called the IRS to inquire about the tax notice and was instructed by the IRS service representative to seek professional help form a Certified Professional Accountant (CPA) to get assistance with preparing a response to the Tax Notice CP****. I had my **** Tax Return reviewed by a CPA and mailed an Amended **** Tax Return to the IRS on December **, ****, after several time extensions from the IRS to conduct research to determine the basis of the property. This property was acquired as part of a divorce settlement and there was no way that I could have correctly determined the basis for this property by only following the instructions given in the TTHB software. **The TTHB software did not address many issues related to correctly determining the basis of the sale of my home. The software is very limited in dealing with the sale of home issues and did not adequately address the issue of determining the basis in my very complicated situation which involves a divorce and many deed searches and transfers of the property over an extended period of time. Information about deeds and property transfers had to be researched and were not available when I prepared my **** tax return. Given the above set of circumstances there was no way that I could have correctly determined the basis for the sale of my home by only using the **** TTHB software.**The Amended **** Tax Return showed a tax due of $**,*** to IRS and $**,*** to DC respectively. The huge difference in tax due shows that TTHB software is not capable and is inadequate for handling the sale of home tax issues when it involves divorce and property division issues. This proves that the inaccuracy in my **** tax return is totally due to my use of the TTHB software which is IRS recommended and accepted by the IRS.**RELIEF OF PENALTY AND INTEREST:*The penalty and interest being imposed by the by the DCOTR is very unfair to me in this case. *Because, the mistake made in my **** DCTR is totally due to my use of the TTHB tax software as explained above. Therefore, the understatement of my **** DCTR is due to the limitations of the TTHB software and was not deliberate on my part. I have made every effort to correct this error as soon as I was informed about it and have filed amended returns with the IRS and DCOTR and paid the correct taxes that was due.*. *I am requesting relief from the penalty and interest of $**,***.** as I have paid $**,***.** which is the total amount of taxes that was due. This tax Return showed a tax refund of $**,***.**I received Tax Notice CP***** AUR Control Number *****-**** in late August of ****.
