The issue in GetHuman1185031's own words
On Saturday, September **, ****, some time after *:**pm, I entered inside the Subway restaurant located in Coxsackie, NY ***** for the second time that day and soon after I sat down and began charging my phone, a male employee approached and told me that “company policy” states that if I don’t buy anything then I have to leave, I then expressed to the employee that I had been inside Subway earlier that day and (out of respect for the establishment), I had asked the manager if it was okay if I charged my phone there and that his manager although reluctantly had said yes. Soon after explaining this to the employee that same manager from earlier who had been outside during my second arrival entered and after bringing to his attention what had just been said between his coworker and I, he said to me in a raised voice that he only let me sit and charge my phone without buying anything earlier that day because he was “trying to be nice” and that company policy states that if I don’t buy, I cant stay. He then continued in a raised voice and rudely told me I had to leave because I can’t “just hangout”, (even though during my first visit there earlier, a young girl who I overheard the manager refer to as his daughter and she refer to him as dad was at that time in fact “just hanging out” more specifically she was sitting at one of the tables right across from me and obviously hadn’t purchased and did not appear to have had purchased anything during the entire duration that I was there, and yet she wasn’t told to leave). I also expressed to the manager that I was not just hanging out, and that I’m sure such a policy doesn’t exist for Subway, he’s only kicking me out due to his own discriminative reasoning. I was not being disruptive, behaving inappropriately, or “just hanging out” I was sitting quietly and peacefully, minding my own business and checking my emails on my phone both earlier and just then while it charged, and that was it, except unlike the first time, this time around I’m essentially being kicked out of a public restaurant for not “buying” anything and accused of “just hanging out”. However, as I was preparing to leave, and out of an effort to diffuse the managers unwarranted hostility towards me I politely told him that I’d have no problem leaving and that I understand that the restaurant could become busy at any moment and I honestly wouldn’t want to take up space from buying customers, but what he was now doing was wrong as far as kicking me out so rudely and especially doing it under the guise of “company policy” and it was probably illegal and definitely unethical and that I would be calling cooperate and filing a complaint against him. He responded by once again telling me to get out. So I left, (some seconds later after exiting I turned back around, approached the door and stuck my head inside with the sole intent of requesting his name or identification for my complaint purposes ) after sticking my head inside the entrance*exit and calmly asking for his name or employee identification, he rudely refused to give it to me and told me to once again get out. Seconds later I realized that he was not going to offer me any identification, or respect so I removed my head from inside the door and left. I would like an apology and for that manager to be identified and replaced.
