Thursday, June **st, ******:**pm EST* *Mrs. Iris Mendoza – Davis***** Greene Street*Philadelphia, PA *********-***-***** *Loan * - *********** *To: Freedom Mortgage* *Subject Premises:***** Greene Street*Philadelphia, PA ****** *Dear* Freedom Mortgage,* **I am writing to you to explain the circumstances which have cause me to become delinquent on my mortgage payments in the hopes that we can find a better solution for what I'm experiencing. Although I am truly sorry I am doing everything possible to improve my situation, which I am still short on the money owed to you. I would greatly appreciate the opportunity to get back on track and back on the bi-weekly installment plan. **The main reason(s) I have become delinquent in my mortgage payments is because of the unfortunate situations that I am facing considering ALL the defects found in the house that are causing hundreds*thousands of dollars to fix. As a first time home owner I was not aware that I had one year to report any of these defects which caused me to suffer from discomfort, annoyance, frustrations and emotional distress. I had to take a medical leave in April of **** due to the high level of stress. All I want is the chance to enjoy my home.**I thought that my house was sound. The inspector have me a positive report. I sealed the deal and purchased my first house which is considered a humongous asset. Just a few months later the nightmare began. When I finally had the opportunity to settle in I've started to notice unsafe living conditions. **My trouble came when the water was interrupted twice months after I moved in. I was under the impression that the pipes were frozen. I also started to notice a damp smell in the basement. **I hired a handy man at great expense, which surveyed the house, and was advised that the leak is one of several major structional deficiencies. It turns out there was an extensive water leak under the bathroom sink causing black mold and minor defects* leaks causing mold due to the deteriorated grouting around the back edge of the sink which had caused me anxieties due to the fungus that can produce toxins that can cause severe illnesses and allergies. There was also no water meter connected to the house. Thus, which it was a big inconvenience?**I've contacted the Water department and reported the issue. I was roughly charged $***.** standard fee to install a water meter and also was taking to court which also caused more extreme stress. The amount due still reflects on my water bill. I believe this should have been the seller's responsibility and I truly believe that she knew of a water meter not being installed before I purchased the house. **December ****, we've noticed the first leak in the backroom which the moisture caused dampness under the paint causing water brownish water stains, followed by peeling paint and swelling along the drywall edges and seams which can lead to lead poisoning. It's difficult to determine where it originates because of weather conditions and the location of the leak making it even more difficult to discover the defects which I am concerned about the leaky roof and level of mold problem coming from the back room, upstairs bathroom, and basement bathroom. **Both Mayor Systems Conked out - Water Tank Conked out -The Water Heater conked out and I had to pay $*** out-of-pocket from Home Depot which caused me to dip into the mortgage money causing the first delinquent of my mortgage payment. **January *th, **** - the air conditioning* heater also conked out and I still don't have heat or air conditioner in the house. **February *th, **** -I've contacted the manufacturer Goodman HVAC at ***-***-**** from Fahrenheit - Elkins Park, *****. A technician name Mr. Ron number ***-***-****. I ma being charge $*,*** for the labor and the parts which I can not afford. I had another mechanic come out who is charging me a few hundred dollars just to look at the furnace, to order the parts and to fix the issue. I have been dipping into my mortgage money just to survive in this house. I had been under a lot of stress, frustration and including depression. of being a first time home owner. **The original home inspector missed ALL of these defects that it's now costing me in the thousands to repair which I don't have. I was not told of the existing defects from the seller of inspector nor did the seller disclose any knows issues about the house that I bought. I truly believes that the seller new the defects and the burden should not fall on my shoulders alone. **According to the PA LAW seller is*was required to maintain the house in reasonable repair and keep it up to the standards of the State. I believe the seller and inspector should bear at least part of the responsibility for the emotional distress that I am suffering. I believe that I have a legal claim and is not with the inspector then towards the seller to file a legal claim for negligence and professional malpractice for ALL the defects against the home seller and damage* damages of purchasing a newly constructed home caused by the severe black mold, emotional distress, missing water meter, conked water heater and heat furnace. **I will like to bring my concerns up to the seller, inspector, and Freedom Mortgage to consider negotiation and mediation. I will also like the seller to undisclosed any and all defects material of the property at ***** Greene Street, Philadelphia, PA *****. **I am asking for consideration to temporarily reduce my mortgage payments at this time or grant me more time to allow me to pay what it's owe or have the seller, inspector pay for the damages that I am facing including the emotional distress. Doing so, would help me to get back on track. **My home means a great deal to me and I desire to work with you to keep my house out of foreclosure. **Please advice me of ALL options available to stop foreclosure at your earliest convenience. I am anxious to reach an agreement and appreciate your prompt respond. I am also working with a specialist at Center At The Park. **Sincerely, Iris Mendoza Davis
