My name is Brenda Brandt. I am writing to notify of violations of the agreement between myself and Capital One Credit Card and Capital One Banking. There have been multiple violations of the card holder and card issuer agreement over the past couple of years. One being in earlier part of **** my DEBIT card that was ALLEGEDLY secure utilizing an EMV microchip card was in my possession in Colorado Springs, Colorado while ON SCHEDULED WORK SHIFT at **** Hancock Expy in Security, Co *****. And I receive notification that money was withdrawn from an ATM. When I called Capital One they advised me that my card was used in Houston, TX. I asked,” How is that possible when I’m in Colorado Springs and at work!?” They stated, “We don’t know. “I stated, “I thought the chip is supposed to prevent fraud and how did they get my card information when it’s in my possession!?” Capital One couldn’t tell me anything, but they did credit it back and never withdrew it again. *Now, here come issues with Capital One Credit card. I have disputed several UNAUTHORIZED and FRAUDULENT transactions over the course of approximately two and a half to three years and Capital One has charged back these disputes. One being I filed unauthorized and their representatives didn’t file these disputes utilizing proper procedures and reasons for dispute so I am charged back for their errors with these disputes process. NOT ONE TIME did any Capital One Disputes Member contact me and ask if I have additional information. And now they charged back $*,***.**. They credited the charge back January **, **** and April **, ****. They now charged the amount back as of May *, **** after receiving WRITTEN notification to Consumer Protection Bureau that they found in my favor and this was resolved. I called May *, **** and spoke with a representative who contradicted herself SEVERAL times in our conversation. First stated she didn’t see the charge credited twice. When I gave her the dates then she indicated it was charged back because they never received any correspondence from me. I stated, “ How is that accurate, you credited it back as soon as I sent my written correspondence after filing a complaint for violating the Federal Banking Regulation when escalations Dept. Gabriella called me before *:** AM, WITH TEXT MESSAGES AND EMAIL TO THE DEALERSHIP TO DISCONTINUE THE FINANCING OF THIS VEHICLE AND THEY WERE SUPPOSED TO REFINANCE MY CURRENT VEHICLE AND I was NOT paying this amount.” Then she stated I filed it as fraud. I stated, “NO, I explained to the representative just as I did now, that it was unauthorized NOT fraud. It isn’t my fault the original representative filed the dispute incorrectly!” Then she stated it’s because I received a new card. I stated, “That’s IRRELEVANT! I RECEIVED THAT CARD IN JANUARY NOT APRIL WHEN YOU CREDTITED IT AGAIN!” I advised her Capital One has exceeded their allotted time frame to dispute this and I want the $*,***.** credited back AGAIN!” She then states can I send the documents again I sent with texts and email. I advised her, “No, I have already supplied these and I do not get paid to continue spending HOURS on the phone with Capital One. They have conflicting reasons to this gross misconduct to their dispute process and charging back twice. You are in violation of the Fair Credit Billing Act. You must investigate and resolve the issue within two complete billing cycles NO LATER THAN ** DAYS AND YOU HAVE EXCEEDED THIS ALOTTED TIME FRAME. *I am refusing to pay the $*,***.** and any interest charged due to these amounts. This after a ***.** charge back for a flight I never scheduled last year and never took that Frontier stated they would reimburse and never did. And after $***.** was billed back for some item because it had tracking. There are a lot of items with tracking that does NOT mean that I IN FACT did get it. I have eighteen open accounts, which include eleven credit cards I can utilize and give my money to. I won’t need to utilize my two Capital One card any longer. These bill backs are incorrect and due to errors made from your investigations department. I am not paying this and will file suit if these. Capital One is reporting to the credit bureaus the $*,***.** amount EVERY MONTH and it is having a negative impact on my credit rating since it is the ONLY credit card reporting as high credit balance. They charge this back right when my cycle date is processing. I am NOT PAYING THIS $*,***.**!! It is and was not valid. There are several discrepancies with this dispute. This should have been credited this amount as specified in the original letter dated ******. I have already filed AND WILL CONTINUE TO FILE COMPLAINTS with the Treasury Department’s Office of the Controller of Currency, Banking Ombudsman, Federal Trade Commission and Better Business Bureau for violations of the Fair Credit Billing Act. I have already paid MULTIPLE charges equaling over $***.** that were billed back due to improperly conducted investigations and will NOT continue to do so. I have given Capital One THOUSANDS OF DOLLARS OF MY MONEY and can just as easily give it to any of the other ** GREAT OUTSTANDING accounts I have in my name. And I have my twin’s sons that just turned ** with credit cards through Capital One. I will have them cancel those too. I am requesting the $*,***.** be credited AGAIN that was billed back on April *, **** and May *, **** AFTER IT WAS CREDITED JANUARY **, **** AND APRIL **, ****.
