Maintain my copyright and licensing rights ... Thumbtack is asking Pro Members to sign a new Terms of Use agreement*contract that relinquishes rights to images posted. It reads that anything a member posts (images for instance) will now be licensed to Thumbtack free of charge for basically any use they want including, but not limited to resale. I am not willing to sign this contract or relinquish any of my image licensing rights without payment. As a professional photographer, any site attempting to take or assume licensing rights to images without payment is just wrong. Please reply with a modified contract allowing Pro Members to maintain all rights to the images they post.
It is a federal crime to infringe on copyright. It is wrong for Thumbtack to force Pro Members to relinquish any rights to their protected personal and professional intellectual property. Currently, Pro Members cannot even access there profile or see jobs without signing the new Terms of Use agreement*contract which relinquishes intellectual property rights.
I want a new Terms of Use contract that does not imply or assume any intellectual property rights of anything posted on Thumbtack by Pro Members.
I have and hope to continue a fair business relationship with Thumbtack as a Pro Member. I pay for the service. If Thumbtack wants licensing rights to my intellectual property they need to pay for those rights not attempt to assume them for free. It's not right.
I will protect my intellectual property rights. Any infringement will be acted on in California and Federal Courts.
