My name is Cerissa Palacio. I have been a member of NYSC- Long Beach for roughly * years now and regardless to the gyms plummeting standards of upkeep and staff I have stayed and been a loyal customer bringing in more people and not once having an issue with anyone, staff or member up until recently. On Monday September **, **** at approximately *:**pm my wife came upstairs with our toddler in her arms to notify me that it is no time to leave since she does not have a phone and the gym refuses to reinstall the phone that once was in the daycare, the fitness manager Pamela Mich was upstairs told her that our toddler cannot be upstairs and my wife without a problem went downstairs. As she was walking out I had noticed Pamela speaking to her client pointing at both my wife and son and her client then proceeded to look at me they chuckled and Pamela continued to speak about me and my family to her client. * Once I was finished doing what I was doing I kindly walked over to fitness manager Pamela and asked her to please not speak about my wife, kids, or about me to her client that it if she had any issues she is more than welcome to speak directly to us as oppose to her client and that what she did was very unprofessional. She then got extremely nasty and started being very immature saying things like “oh youre a mind reader now? Oh youre a lip reader? “ and I simply told her no im telling you what I saw and asking you not to do that again. I proceeded to walk to the door and she starts again telling her client “oh that’s it shes done shes done” so I then turned around and said this is exactly what im talking about next time if you have something to say speak directly to me and not when my back is turned and especially not to a client she then proceeded with “ im going to revoke your membership watch youre nobody in the gym im part of the board just watch” and I said okay well then lets go talk to someone and she said “im going to get security” I said for what who do we have to talk to want to go talk to Paul who is the general manager or who? “ we both went downstairs and we both spoke to the young lady Karen who was at the front desk and I went about my day returning at * o’clock as I usually go to the gym twice a day and I compete in bodybuilding competitions and am very well respected in the fitness community as well as long beach all together. I came back only to have multiple members come up to me and tell me that Pamela told them about what happened and there was a lot of gossip because again pamela was gossiping with her clients about members of the gym of course without knowledge that they know me. I returned for the rest of the week up until Friday September **, **** now four days after the incident and get a call from Paul the fitness manager asking me what happened I told him what happened an he told me that “he spoke to the fitness manager and she said that I threatened her life and filed a police report against me and that he wants to hear my side of the story so he can straighten it out but until then I am no longer allowed into the gym because of the police involvement. I asked him when, who , and if he had a copy of it because I did not threaten her life it was an argument and if she did file against me I would have been notified by now he said he could not give me that information. Once we got off the phone I went to the local precinct and asked them if there was a report which there was not. I then returned to call paul and he told the employees working that afternoon to not forward my calls to him yelling at them about transferring the calls and not to tell me that he was there again without knowing that those employees have known me for a very long time and know I am not that kind of person. Once I was finally able to speak to paul I told him I followed up with the police station and that there is no police report and he said he has no proof and that he is taking this matter seriously and that he cant allow me into the gym then I said how are you taking it seriously with false information instead of following up with the police before accusing me and slandering me without any proof so why am I suspended he said don’t tell me how to do my job im following proper protocol so I then asked where in the employee handbook does it state this so I can check for myself and he said I don’t know so I said so then how are you following proper protocol if you don’t know where it states youre following protocol he then told me that hes just following instructions from josh and that he will no longer have this conversation that he will contact me when everything is finalized and figured out he then proceeded to cancel my membership and I found out through his employees not through him. * Unlike the employees at this location I am taking this matter very seriously and have filed an incident report with the police station against NYSC and Pamela Mich. What I am not understanding is that if my wife politely walked back down the stairs and moved forward why the situation had to escalate by Pamela speaking negatively about my family to another member when she is the fitness manager and has no right to speak on my family and especially as a fitness manager has no business gossiping with her clients as she is suppose to represent the gym as an employee. Another thing I don’t understand is that the only reason my wife even felt comfortable bringing our child up in her arms is because the gym allows for Karen (an employee) have her son there all day in and out of day care hours walking around the gym in the weight room and all around the gym as if that’s not more of a liability to have a * years old running around the gym and my wife holding a toddler for less than * minutes upstairs. Also, I do not understand how management finds it perfectly okay that the fitness manager can be so rude, nasty, and unprofessional to members and staff. I have multiple witnesses who were there at the time of the incident both members and employees who were there. Also, if my membership was revoked because of “police involvement” then how come the police is not involved. Now I have contacted my lawyer and I will be taking further steps for failure to abide by TSI Code of ethics and business conduct and for defamation of character and discrimination. I have already mentioned I compete for the National Physique Committee and will take further steps to sue NYSC of Long Beach
