December *, *****PayFlex**RE: *Request for Refund of Unearned Premium**Louisiana Revised Statute Title **:*****Employer: *MDU Resources* USI Industrial**Employee: *Shannon Lemoine**Group ID: ***********To Whom it May Concern:**Please be advised this is a formal written request for the refund of any unearned premiums paid in advance for the following coverage period: August *, **** – August **, ****. During this coverage period, “COBRA” benefits overlapped with group benefits due to the rehire of the employee Shannon Lemoine on August *, ****. Continuation coverage provided under the Consolidated Omnibus Budget Reconciliation Act of **** (COBRA) was effectively terminated at the time of rehire. However, the employee had already pre-paid the full “COBRA” premium for the month of August ****. As a result, there was a duplication of paid premiums for the August coverage period. **To retain both premiums would violate the definition of “applicable premium” under Title ** US Code ***** (*) which states: “The term “applicable premium” means, with respect to any period of continuation coverage of qualified beneficiaries, the cost to the plan for such period of the coverage for similarly situated beneficiaries with respect to whom a qualifying event has not occurred (without regard to whether such cost is paid by the employer or employee).” Emphasis added.**Furthermore, Louisiana Revised Statute Title ** ***, Paragraph **, states in pertinent part: “Policyholders shall have the right to cancel their policy and receive a refund of any unearned premium.” Emphasis added.**Since the employer provided group coverage retroactive to August *, **** then the unearned premium would be ***% of the employee paid amount for the August coverage period.
