Can I receive unemployment benefits if I am receiving severance pay?

Asked a year ago
Yes, you may be eligible to receive unemployment benefits even if you are currently receiving severance pay. In Montana, receiving severance pay does not automatically disqualify you from unemployment benefits. Instead, the state considers the terms of your severance agreement. If the severance pay is being provided as a continuation of wages for a specific period and you are able and available to work, you may still be eligible for benefits. However, if the severance pay is given as a lump sum or in a manner that prohibits you from seeking new employment, it may affect your eligibility. Each case is evaluated individually, so it is recommended to file a claim for unemployment benefits and provide the necessary details about your severance pay for a proper determination.
