Applied for refinance loan in June **** from Chase Bank in Grass Valley, CA on a Bay Area duplex rental property with high equity. I am P.O.A. Agent for my husband who is currently and legally incapacitated and is in a skilled nursing home. The property is in my husband's Revocable Trust. He is the "Grantor". He is currently incapacitated, so I am currently his appointed P.O.A. Agent and Successor Trustee with legal broad powers to take loans on his properties or sell, etc., and act on his behalf. I applied for a refinance of his property in order to pay his ongoing medical expenses and to get a fixed mortgage interest rate. One problem occurred: Chase recently denied the refinance loan, they said, "due to Fannie Mae Guidelines that (apparently) require the Borrower to be the Grantor of the Revocable Trust." My husband is the Grantor, but cannot act on his own behalf because he is cognitively and physically incapacitated. Therefore, I, as his P.O.A. am ACTING on his behalf. He needs the refinance loan on his property asap to pay high medical expenses. Without the loan we do not have the needed funds to pay his needed nursing home care. You can see our dilemma. Can you please help, i.e., make an exception to your requirement that the "Grantor" must be borrower (my incapacitated husband who cannot make decisions) to allow me as P.O.A. and Successor Trustee*to ACT on his behalf so he can be granted a refinance loan on his property? Note: The LTV (loan to value) very high equity in the property. My appointment as his P.O.A. IS to act on his behalf when he cannot and, sadly, he no longer can act on his own behalf. Because of this we need your help. Please help resolve this very troublesome issue asap. Thank you so very much, DMSmith
