My name is Carlos Cardenas and my younger brother Stephen Cardenas is employed as a runner at Studio Movie Grill in Bakersfield, California. On November **, **** I was contacted by a manager indicating that Stephen was injured at work. Several attempts were made to contact my mother Alma, but to no avail. Stephen was sent to Accelerated Urgent Care on Calloway Dr in Bakersfield, California* however, Stephen was informed that he was unable to receive medical services at that location. Stephen was then referred to Accelerated Urgent Care on Stockdale Highway in Bakersfield, California* however, Stephen was once again denied medical services. Stephen was referred to Mercy Southwest Hospital on *** Old River Dr in Bakersfield, California. Stephen contacted the Studio Movie Grill general manager named Robert Scharf "Teejay" to inquire about workers compensation forms that were required at the hospital. Robert Scharf replied to Stephen by stating, "You know you really don't have to call over here!" Stephen replied by stating, "Well the hospital needs the workers compensation forms and I thought since you are the general manager that I could speak to you?" Robert replied, "Stop calling over here and if the hospital needs anything they can call us here!" Stephen is young and has never experienced an injury at work so he was well within reason to contact his employer to ensure that he is guided through the workers compensation process correctly. I contacted Robert and introduced myself in a professional manner by stating, "Hello Teejay, my name is Carlos Cardenas and I am Stephen Cardenas's older brother. I was just inquiring about how your company's workers compensation process works with regard to assisting its injured employees?" Robert responded in a condescending and combative manner, "First of all, I did not employ you!" I could not believe the blatant disrespect exhibited by a general manager and I unfortunately lost control at that moment. I was not going to permit this individual who I have never met to insult me and speak to me in such a disrespectful tone. I engaged in a back and forth argument with Robert insulting one another utilizing profanity. I informed Robert that I would be contacting the corporate office to inform them on the unacceptable manner in which Robert treats his injured employees leaving them in the dark with regard to fending for themselves. I acknowledge that I should not have lost my composure and permitted Robert's lack of professionalism to get to me, but I could not accept his blatant disregard for my brother's health. Robert displayed no concern for my brother and spoke to me as if I was a young delinquent. I am flabbergasted with the fact that Robert is the general manager and feels that he has the right to speak to a complete stranger over the phone in a condescending and disrespectful manner. Of course, once I informed Robert that I would be contacting corporate to report his unacceptable behavior, he immediately went to Mercy Southwest Hospital to "check" on Stephen. He informed Stephen about our verbal altercation and stated that I was out of line. However, he failed to indicate how rude he was towards me. Robert also attempted to downplay to Stephen that he did not intend to come across as being rude to Stephen during their earlier phone communication. Robert indicated that Stephen took his "rudeness" out of context. Stephen responded by stating, "I took it exactly how it came across which was rude." Robert solely went to the hospital to cover his tracks and attempted to portray himself as someone who cares. Robert was disingenuous in his interaction with Stephen at the hospital and failed to provide the hospital with the necessary workers compensation paperwork. As a result, the hospital informed Stephen that he would be billed privately for medical services rendered. I understand that perhaps Studio Movie Grill managers necessitate training in effectively dealing with injured employees* however, Robert's blatant disrespect towards Stephen and myself is unacceptable* unprofessional* and unbecoming of an individual in a managerial position. Stephen informed me that the majority of Studio Movie Grill employees fear Robert because he treats them in an unfair and authoritarian manner. I definitely experienced first hand what type of unsavory character Robert is and if he felt comfortable enough to speak to me with such disregard without knowing me, I can't begin to imagine to what degree Robert treats his employees. I am still in utter disbelief that Robert is a general manager with such a distasteful attitude and negative demeanor. I understand that each individual is entitled to have a bad day, but I can not accept the manner in which my brother's injury was handled today (**********). I do not harbor any ill will towards Robert nor wish him bad luck, but I truly believe that further evaluation should be conducted to discover how Robert performs the scope of his duties as a general manager. It is unjust to treat anybody with disrespect, especially being in a position of power. Perhaps, Robert is accustomed to treating individuals with a lack of empathy or compassion and this time around he met an individual in myself that refuses to accept this type of unfavorable treatment and am determined to advocate for those who do not have a voice. I am not looking for any type of freebies or compensation* rather I am requesting that Studio Movie Grill acknowledge that this type of behavior displayed by a general manager will not be tolerated and addressed to preclude this type of issue from arising in the future. Leadership starts from the top and Robert is obviously lacking the necessary people skills to be an effective and respective leader. I look forward to speaking to somebody soon regarding this matter.
