I have been coming to this store for ** years regularly. Last night ******** at around *:** pm I came in with a cart that had * bags of returns as well as * lamps not in the bag due to size. I ALWAYS leave my cart at an end of an aisle where it is easier for other customers to get by. I tend to find if I walk the cart down the aisle or use the back aisle where all the pictures etc to keep my cart close that other customers cannot get by because the aisles are too narrow. I then wander up and down the nearer aisles bringing stuff back to the cart. As I get farther I grab the cart and move it. If I have been distracted for too long I will hear an employees ask if the cart belongs to anyone and I say yes and move it closer to me. Last night I came back to put stuff in my cart as I was measuring large picture frames for a remodel of my condo to find the cart gone. I walked all over the store and finally found it in the fitting room area. The woman there (very rude she scolded me for leaving my cart unattended) told me the employee who had found it had taken some things out of the cart out of the bag because she could not see them on the receipts in the bag...( a clear indication that the cart is not abandoned as it had personal property in it) I then ran and found her and she was coming back carrying * of the items she was very nice and apologized and handed them to me. I asked her if she had taken anything else out of the cart and she said yes a rug, she then ran and grabbed it and brought it back to me at that point I asked her if she had removed anything else from my cart and she said no.. I then finished my shopping and went up to the return desk I returned all of the items except the * lamps as I could not find the receipt thinking maybe I left it at home I purchased my new items and let the supervisor (no manager was on duty) know that the employee in the dressing room was rather rude to me and then I went home. At home I went through my receipts and that is when I realized the employees had also removed a decorative picture that had the receipt for both the picture and the lamps tucked in it. I immediately called the store and the supervisor Wendy told me that she could not guarantee anything as I should not have left my cart un attended with items I had purchased in it. I described the picture and told her the girl who removed the items would know right away what it was. She took my info and then called me back to state the girl had found it and it would be upfront for me but that there was no receipt. I said it had likely fallen on the floor when she removed the picture from my bag in the cart since it was lightly tucked inside to keep my receipts separate for the return was I like to be organized she was unwilling to have her employee look for the receipt. I get that I run the risk of a customer taking something out of my cart and the store is not responsible for that but to have any employee remove items is the stores responsibility. My big issue is without the receipt that is less than ** days old I cannot get my money back fro the picture or my lamps I never return items without a receipt because they will often give you pennies on the dollar saying it has drastically been marked down... I am VERY upset as I am a long time loyal customer and they never should have touched the items in the cart as she acknowledged that there were receipts and they were in bags that had no tags and were not from Ross these were obviously prior purchased items so the likelihood that the cart was actually abandoned is not possible as no one would reasonably not come back for items they own... I get that the store moved the cart out of concern but to remove any item that I purchased prior and therefore own is clearly theft...whether the employee understood that or not , it is theft to remove my property and attempt to put it back on the floor to be sold again. I want to be able to return the * lamps and the picture as originally intended not for a store credit but back to my credit card... I leave my cart in TJ Maxx and have never had an issue... I have not taken to twitter or Facebook as of yet but I would like to know how this will be resolved... *Sincerely,*Peregrine Schwald
