I would like to bring to your attention the worrying situation that is arising in Edinburgh, Scotland regarding Air BnB. **Together with two other hosts, my wife and I have spent the past * months going through the process of a legal appeal against a decision made by the City of Edinburgh Council to issue an enforcement notice that requires us to cease letting out our properties to short stay visitors indefinitely. The council claim that the current use is having a detrimental impact on the residential amenity of our neighbours (** apartment block, * of which are entire home Air BnB listings) and despite no evidence to suggest this in the form of noise monitoring or other surveys etc, the reporter has decided to dismiss our appeal.*We now have two months before we must completely remove our listing, which was just last week upgraded to the new plus status*Please know that we are responsible hosts and reasonable people who would never willingly cause distress * disturbance to our neighbours. The council’s action stems from a single resident in the block who has taken it upon himself to wage war against the ideaof Air BnB through vandalism, persistent harassment of guests and multiple false noise complaints to the council. The honest truth is that there is no real detrimental impact caused by Air BnB use. Our reviews and listing speak for themselves. After nearly two and a half years of hosting, we have met people from all over the world, every single one pleasant, friendly and just happy to be visiting Edinburgh. Nobody has ever caused malicious damage in the apartment and I have never received complaints from neighbouring apartments regarding noise or antisocial behaviour.**Basically, when you look at this situation from a simple right or wrong perspective, it is wholly wrong that the council can ban us from letting our place through air bnb outright with zero evidence to suggest that the use was having a detrimental impact on residential amenity. We worked so hard and invested heavily in the purchase and renovation of the property to an extremely high standard and now must face an uncertain future due to a decision made by an ill-informed local authority who is completely unwilling to cooperate and reach a compromise with Air BnB hosts in the city. *I believe we are among the first of many who will be forced to go down this route in the coming weeks * months and feel that unless we take some form of action, Air BnB is under threat in my city. **With the help and support of Air BnB, we could take our case to the court of session and fight to halt the ‘buldozer’ action being taken by the council. We have * weeks to do so but I believe our case is strong and If successful, it would set a precedence for future challenges in the city and ultimately make people sit up and take a proper look at the facts before making a cut and dry decision based on speculation and opinions. A successful case would have a huge positive impact on Air BnB in Edinburgh. My wife and I are so proud of what we have built. To be upgraded to plus status now just confirms that we were doing it right. Please help us to hold onto that.
